Terms and conditions
1. Parties to the Sales Agreement
The Parties to the sales agreements are:
- AlmaItalica S.r.l. as the Seller;
- The Buyer (consumer)
2. Products
2.1 – The sale concerns exclusively the Products shown in the relevant sections of the Alma Italica S.r.l. website – electronic catalogues.
2.2 – The Products covered by each individual contract are those agreed by the Parties in the offer, the order and the order confirmation, or in any communications between the Parties leading to the conclusion of the Agreement.
2.3 – The Products, type, quality, agreed quantity, the methods and date of shipment, packaging and any other specific condition negotiated between the Parties are stated in Alma Italica S.r.l.’s offer.
2.4 – Published photos are for illustration purposes and may not match the original product.
2.5 – The Parties declare that they have carefully reviewed the conditions for entering into the Agreement. Restricted access to the site will allow the Buyer to view a summary of orders placed.
3. Sale Prices
3.1 – All sale prices of the Products offered in the electronic catalogues on the Alma Italica S.r.l. website, shown in euros, include VAT.
3.2 – Shipping and delivery costs for the Products are borne by the Buyer and are shown in the order. These costs are calculated automatically based on the weight and volume of the order, unless otherwise agreed between the Parties.
3.3 – Shipping costs are paid by the Buyer directly to AlmaItalica S.r.l.
4. Product Availability and Orders
4.1 – The Buyer may purchase the Products listed in Alma Italica S.r.l.’s electronic catalogue, subject to the type and/or available quantity.
4.2 – Upon receipt of the order by Alma Italica S.r.l., the system will automatically send the Buyer an e-mail confirming receipt of the order.
4.3 – The Buyer’s order will be fulfilled within the limits of available Product quantities and may also be confirmed only in part.
4.4 – If some ordered Products are no longer available, Alma Italica S.r.l. undertakes to contact the Buyer within 7 days from the order date to inform them. In such case, the order will be cancelled or partially accepted.
4.5 – In the event of order cancellation or non-delivery, Alma Italica S.r.l. undertakes to issue a refund within 14 days.
5. Conclusion of the Agreement
5.1 – The Agreement is deemed concluded when the Buyer receives the order confirmation by e-mail. Delivery of the Products is subject to payment having been made, which must be completed at the same time as the order.
6. Cancellation of an Order
6.1 – The Buyer has 30 minutes to revoke the order. Such revocation may be made by sending an e-mail to the support address provided by Alma Italica S.r.l.
6.2 – After the 30-minute period, the order will be processed by Alma Italica S.r.l. for shipment.
6.3 – If the order is already being shipped or has been shipped, it will not be possible to revoke it.
7. Minimum Amount and Payment Terms
7.1 – The minimum purchase amount is set by Alma Italica S.r.l. and indicated in the online offer.
7.2 – Payment must be made according to the conditions specified in the cart and in the order confirmation e-mails, using the available payment systems (e.g. PayPal, Stripe).
7.3 – The tax documentation relating to the ordered Products will be issued by Alma Italica S.r.l. upon conclusion of the agreement.
8. Delivery Methods
8.1 – Alma Italica S.r.l. will handle delivery of the Products to the Buyer directly through trusted couriers and/or shippers. Delivery times will be indicated in the order confirmation e-mail.
8.2 – The goods will be delivered to the address provided by the Buyer in the order or otherwise agreed between the Parties. In the absence of explicit instructions, delivery will be made to the address associated with the Buyer’s account on the website.
8.3 – If the Buyer is absent at delivery, a notice will be left to contact the courier and arrange a new delivery. In this case, the risk of deterioration of the Products will be borne by the Buyer.
8.4 – The Parties may agree on different delivery methods, such as direct collection at a retail point.
8.5 – The risk of loss or damage to the Products passes to the Buyer upon receipt of the goods.
8.6 – The Buyer must check the condition of the goods upon delivery and report any damage to the courier.
9. Role and Liability of AlmaItalica S.r.l.
9.1 – Alma Italica S.r.l. undertakes to keep the Product information and the sales conditions published on the website accurate and up to date. AlmaItalica S.r.l. is liable for any discrepancies between the published information and the delivered Products.
9.2 – The Buyer has the right to withdraw from the agreement without any penalty within 14 days from receipt of the Products, except for goods that are not subject to withdrawal (e.g. customised products or sealed goods for hygiene reasons).
9.3 – In the event of defects or non-conformity of the Products, the Buyer may choose between:
- repair or replacement of the Product;
- a price reduction;
- termination of the agreement and a refund.
10. Legal Warranty
10.1 – Alma Italica S.r.l. is liable for any lack of conformity of the Products that becomes apparent within 2 years from delivery. The Buyer must report the defect within 2 months of discovery.
10.2 – The warranty does not cover damage resulting from improper use or normal wear and tear.
